EL CAJON – Jury deliberations began Thursday in the Superior Court trial of an electrician charged in the 2005 shooting death of a homeless man that his ex-girlfriend had befriended.

Jeremy John Lutz, 29, also is charged with kidnapping and raping his ex-girlfriend.

The woman testified that Lutz shot Thomas Benjamin on Sept. 15, 2005, through the window of her parked car at a commuter parking lot off of Interstate 8 at Los Coches Road.

Lutz's lawyer, Deputy Public Defender Arturo Herrera, argued that the woman's testimony wasn't credible because “she was stoned out of her mind” on methamphetamine on the day of the shooting.

Lutz said he never saw Benjamin the day he was killed and never went to the commuter parking lot.

Deputy District Attorney Allison Batstone said physical evidence linked Lutz to the crimes. Markings on bullet casings indicated they were fired from Lutz's handgun, which was recovered in a cow pasture near Santa Ysabel where Lutz was arrested, she said.
